BOARD OF MARINE DECK OFFICERS

EXCLUSION OF TONNAGE LIMITATION REQUIREMENT FOR OFFICERS-IN-CHARGE OF A NAVIGATIONAL WATCH AND MAJOR PATRONS ON BOARD SHIP ENGAGED OR NEAR COASTAL VOYAGES

WHEREAS, the Board of Marine Deck Officers (Board) issues Certificate of Competency and Endorsement Certificate to Officers-in-Charge of a Navigational Watch, and an Endorsement Certificate to Major Patrons with limitation as "valid only on ships of less than 500 GT engaged or near coastal voyages", pursuant to paragraph 5 of Regulation II/3 of the 1978 STCW Convention, as amended.

WHEREAS, with the progress in the shipping industry, building of ships increased in size and tonnage, even with those ships engaged only on near coastal voyages, such, that it becomes too competitive for our Officers-in-Charge of a Navigational Watch and Major Patrons registered with the Commission which place them in jeopardy of losing their employment to other nationalities should the tonnage limitation requirement in the Certificate of Competency and Endorsement Certificate remain to ships of less than 500 GT.

WHEREAS, in order to avoid the drawback stated in the preceding paragraph, it becomes imperative to promptly address the impending problem by excluding the tonnage limitation requirement in the Certificate of Competency and Endorsement Certificate to Officers-in-Charge of a Navigational Watch and Endorsement Certificate to Major Patrons, pursuant to paragraph 1.8.4, Section B-1/2, of the STCW Code, and change the title of the STCW Regulation to Regulation II/2, par. 3, subject to the limitation that the ship is engaged only on near coastal voyages, without therefore violating any STCW Regulation.

WHEREFORE, the Board resolves, as it hereby RESOLVED, to exclude the tonnage limitation requirement in the Certificate of Competency and Endorsement Certificate of Officers-in-Charge of a Navigational Watch and Endorsement Certificate of Major Patrons engaged on near coastal voyages, and which shall now read as, "valid only on ships engaged on near coastal voyages" under Regulation H/2, par. 3.

RESOLVED FURTHER, that a Major Patron shall be issued a STCW Certificate of Competency, in addition to the Endorsement Certificate pursuant to the 2010 Manila Amendments to the STCW Convention, and Officers-in-Charge of a Navigational Watch and Major Patrons applying for the issuance of Certificate of Competency and Endorsement Certificate must have a seagoing service of at least one (1) year on board ships having an equivalent tonnage to the ship which they will board; and that they have completed the revised Management Level Course.

This Resolution shall take effect fifteen (15) days after its complete publication in the Official Gazette or in a newspaper of nationwide circulation.

Let a copy of this Resolution be furnished the U.P. Law Center.
