RATIONALIZING THE NATIONAL COUNCIL ON DISABILITY AFFAIRS

WHEREAS, the President is authorized under the Constitution, Presidential Decree (PD) 1416, as amended by PD 1772, the Administrative Code of 1987, and the General Appropriations Act, to reorganize the National Government;

WHEREAS, Executive Order (EO) 366, s. 2004, directed the strategic review of the operations and organizations of the Executive Branch and provided options and incentives for government employees who may be affected by the rationalization efforts of the agencies of the Executive Branch;

WHEREAS, the President through Memorandum Order 19Q, s. 2005, authorized the Secretary of Budget and Management to approve the Rationalization Plan submitted by the Departments and Agencies of the Executive Branch, including Government-Owned and/or Controlled Corporations, in order to ensure the effective implementation of EO 366;

NOW, THEREFORE, I, FLORENCIO B. ABAD, Secretary of the Department of Budget and Management, by authority of the President of the Republic of the Philippines, and by virtue of the powers vested in me by law, do hereby approve the Rationalization Plan of the National Council on Disability Affairs specified herein, and order:

SECTION 1. Rationalization.—The National Council on Disability Affairs, hereinafter referred to as the NCDA, is hereby rationalized functionally and structurally, in accordance with the provisions of EO 366 and its implementing Rules and Regulations;

SEC. 2. Functional Shift.—The NCDA shall continue to perform its functions as provided for under EO 709, s. 2008, in consonance with the mandate of providing persons with disabilities the fullest measure of protection and assistance to develop their abilities.

SEC. 3. Structural Shifts.—The following units are hereby renamed:
Office of the Chairman to Office of the Chairperson
   
Administrative Division to Finance and Administrative Division; and
   
Technical Cooperation Center to Technical Cooperation Division.
In addition, the management of the day-to-day operations of the Council Secretariat shall be removed from the Chairperson and remain with the Executive Director to avoid the duplication of functions between said officials.

SEC. 4. Staffing Shifts.—Aligned with said structural shift, the Department Undersecretary and Department Assistant Secretary positions shall be abolished after 31 October 2010, consistent with the Office of the President's Memorandum Circular No. 2 dated 29 July 2010.  The Chairmanship of the Council shall revert back to the Secretary of the Department of Social Welfare and Development, and the Council shall likewise be attached to said Department.

The rationalized staffing pattern of the NCDA shall consist of 61 positions, to include the aforementioned Undersecretary and Assistant Secretary positions, and two (2) more positions marked coterminus with the incumbent.

SEC. 5. Separability Clause.—If any provision in this Rationalization Plan or the application of such provision to any circumstance is declared invalid or unconstitutional, the other provisions not affected thereby shall remain valid and subsisting.

SEC. 6. Repealing Clause.—All laws, executive issuances, rules and regulations, or parts thereof which are inconsistent with the Rationalization Plan approved herein, are hereby repealed, amended, or modified accordingly.

SEC. 7. Effectivity.—The Rationalization Plan provided herein shall be effective for implementation upon approval hereof.
