RESOLUCION
AUTORIZANDO EL NOMBRAMIENTO DE UN COMITE QUE SE ENCARGUE DE PREPARAR UN PROYECTO DE REGLAMENTO DE LA CONVENCION.Se resuelve, Autorizar, como por la presente se au-toriza, al Presidente de la Convencion a nombrar un Co-mite compuesto de siete Delegados para que prepare un proyecto de Reglamento de la Convencion y lo someta a la misma dentro del termino de cinco dias a contar desde la fecha en que se aprueba esta Resolucion.
SR. NEPOMUCENO: Pido que se apruebe, Sr. Presidente.
EL PRESIDENTE: ¿Esta dispuesta la Asamblea a votar?
(Una mayoria: Si).
Los que estan conformes con el proyecto de resolution, que digan Si. (Varios Delegados: Si.) Los que estan en contra, que digan No. (Silencio.) Queda aprobado.

Me permito, sin embargo, llamar la atencion de la Asamblea al hecho de que en la linea 10 de la primera pagina, se omitieron dos palabras: la "o" y "contraprotestas."

RESOLUCION
ADOPTANDO REGLAS PARA LA TRAMITACION DE PROTEST AS Y CONTRA PROTESTAS SOBRE LA ELECCION DE DELEGADOS A LA CONVENCION CONSTITUCIONAL.Se reseulve, Adoptar, como por la presente se adop-tan, las siguientes reglas para la tramitacion de protestas y contra protestas sobre la eleccion de Delegados a la Convencion Constitucional.
REGLA I.
Siempre que, a juicio del Comite de Credenciales y de Elecciones, puede originar gastos la tramitacion de una protesta o contraprotesta electoral, queda autorizado dicho Comite a exigir de la pane que presenta protesta un deposito de dinero en efectivo cuya cuantia y plazo dentro del cual debe efectuarse seran fijados por el referido Comite en cada caso particular. Si, expirado el plazo fijado, no se hace dicho deposito, el Comite podra declarar sobreseida la protesta o contraprotesta en cuestion.
REGLA II.
En tales protestas y contraprotestas y en todo cuanto se refiere a alegaciones, vistas y pruebas, regiran aquellas disposiciones contenidas en el Procedimiento Civil y en la Ley Electoral vigentes que, a juicio del Comite de Credenciales y de Elecciones, sean aplicables, asi como las practicas que en esta materia han quedado sancionadas por la Corte Suprema y por la Legislatura Filipina: Entendiendose, que con el fin de hacer justicia a todas las partes y evitar dilaciones innecesarias, los plazos para la presentacion de los escritos de alega-ciones, pruebas e informes, seran fijados por el Comite de Credenciales y de Elecciones en cada caso determinado.
SR. ROMUALDEZ: Pido que se apruebe.
SR. RAMOS: Sr. Presidente.
EL PRESIDENTE: Sr. Delegado.
SR. RAMOS: Tengo entendido que ya habiamos cerrado el tiempo para la presentation de las protestas.
EL PRESIDENTE: El proyecto de resolucion se refiere a las protestas presentadas.
SR. RAMOS: ¿Quiere decir que se pueden admitir nuevas protestas?
EL PRESIDENTE: No, esas son protestas presentadas ya desde el primer dia.
SR. RAMOS: Pero aqui se dispone, por ejemplo, en la regla segunda, que en cuanto se refiere a las alegaciones, se regiran por el Codigo de Procedimiento Civil o por la Ley Electoral. Suponiendo que aquellas protestas presentadas antes de haber expirado el plazo para la presentacion de las mismas no estuviesen de acuerdo con estas reglas del Codigo de Procedimiento Civil o de la Ley Electoral, ¿como quedarian?
EL PRESIDENTE: El Sr. Delegado por Leyte, Hon. Romualdez, tendria la amabilidad de dar las aclaraciones que se solicitan.
SR. ROMUALDEZ: Segun el acuerdo del Comite, el Comite se reserva el derecho de dar oportunidad a las partes para ser oidas.
SR. RAMOS: En ese caso, ¿no cree Su Señoria que seria conveniente insertar una enmienda a fin de que se aclaren las cosas y no demos lugar despues que los pro-testados se aprovechen de la falta de una disposicion en ese sentido?
SR. ROMUALDEZ: ¿Cual seria la enmienda que propone Su Señoria?
SR. RAMOS: Yo propondria la enmienda en la forma siguiente: En el caso de aquellas protestas ya presentadas en cuanto se refieren alegaciones, no estuviesen de acuerdo con las disposiciones del Codigo de Procedimiento Civil o con la Ley Electoral, que se permitan a los protestantes o contraprotestante a que presenten las enmiendas correspondientes de tal suerte due puedan hacer que esas alegaciones se conformen con las disposiciones de estas leyes.
SR. ROMUALDEZ. En sustancia esa es la intencion del Comite. Si eso se quaere expresar en la resolucion, por mi parte, no tengo inconveniente.
EL PRESIDENTE: ¿El Delegado por Leyte acepta esa enmienda?
SR. ROMUALDEZ. Quisiera que se formule por escrito la enmienda.
SR. SUŃER: Si no tiene inconveniente el Delegado yo voy a enmendar la enmienda en ese sentido.
EL PRESIDENTE: Vamos a hacer que se formule la enmienda por escrito para que se sepa cual es esa enmienda.
SUSPENSION DE LA SESION
EL PRESIDENTE: Si no hay objecion, la Mesa suspendera la sesion por algunos minutos. (No hubo objecion.)

SR. RAMOS: Sr. Presidente, despues de una debida explicacion dada por los Miembros del Comite de Credenciales, retiro mi enmienda.
EL PRESIDENTE: El Delegado por Pangasinan re-tira su enmienda. ¿Hay alguna objecion? (Silencio). La Mesa no oye ninguna. Se da por retirada. ¿Hay alguna otra enmienda?
MR. JOVEN: Mr. President, for a privileged motion. I move that the two rules embodied in this resolution be considered and discussed separately; that is, one by one in the order they are set forth in this resolution .
THE PRESIDENT: Is the Gentleman going to propose an amendment to the resolution?
MR. JOVEN: Yes, sir, I will propose an amendment.
THE PRESIDENT: The Gentleman may propose his amendment.
MR. JOVEN: I move to amend Rule No. 1, of this resolution, lines 13 to 16, so as to make the last sentence read as follows: "If the period fixed expires and said deposit is not made, the committee shall report this fact to the Convention, which will decide if the protest or counterprotest in question should be dismissed". I shall try to translate it into Spanish, Mr. President.
(Traduccion). "Si expirado el plazo fijado, no se hace dicho deposito, el Comite dara parte de este hecho a la Convencion la cual decidira si procede o no procede el sobreseimiento de la protesta o contraprotesta en cuestion."
EL PRESIDENTE: ¿Que dice el Comite de Credenciales ?
SR. ROMUALDEZ: Sr. Presidente, siento no poder aceptar la enmienda propuesta, porque en primer lugar ese originaria dilacion innecessaria y, en segundo lugar, el mismo proyecto dice: "podra declarer". Quiere decir que se concede al comite discrecion o direccion sobre cuando debe y cuando no debe declarar sobreseida la protesta. Creo que es innecesaria la enmienda.
MR. JOVEN: Mr. President, I would like to say a few words regarding my amendment.
EL PRESIDENTE: Tiene la palabra el Caballero por Ilocos Sur.
MR. JOVEN: Mr. President and Gentlemen of this Convention; I believe that the question whether or not a Member or any Member of this Convention should continue to be such, is of vital importance, not only to the Members against whom protests have been made, but also to the Convention. For this reason, I believe that the power to decide whether or not a protest or a counterprotest be dismissed should not be delegated to the Committee on Credentials and Elections. This Convention should retain such power, because as I have said ....
SR. KAPUNAN: Para una pregunta al orador.
EL PRESIDENTE: El orador puetle contestar, si le place.
SR. JOVEN: Si, señor.
SR. KAPUNAN: Con la teoria de Su Señoria, ¿no cree seria mejor que no exista ya ese Comite y que la facultad de decidir se conceda ya a la Convencion?
MR. JOVEN: As I said, Mr. President, that power to decide is so important that it should not be delegated to a body, say the Committee on Credentials and Elections . I believe that this Assembly as a body should retain such power because, as I understand from this resolution or from this rule, the Committee will be empowered to decide finally whether or not a protest or counterprotest should be dismissed. As it is worded, Mr. President and Gentlemen of this Convention, the resolution gives the Committee, under lines 13 to 16, the power to decide finally whether the protest or counterprotest be dismissed, and precisely my amendment consists in changing or altering this provision so as to take away that proposed power from the Committee and give it to the whole Body of this Convention.
MR. PEREZ (T.): Mr. President, will the Gentleman yield?
EL PRESIDENTE: El orador puede contestar, si le place.
MR. JOVEN: With pleasure.
MR. PEREZ (T.): Once the deposit is fixed by the Committee, and the committee with which that deposit should be made is designated, and no such deposit is made, does the Gentleman wish us to understand him as saying that the Convention should take greater concern than the protestant himself over his failure to place the deposit within the time required by the committee?
MR. JOVEN: I do not mean that; but for one reason or another the Member against whom a protest has been made may not have made a deposit within the time fixed by the Committee on Credentials and Elections. My amendment will give opportunity to that Member to present to the Convention as a whole his reasons why he has not made the deposit on time, and if the Convention will decide that his reasons are valid, then this Convention will possibly permit him to make the deposit and therefore his protest or counterprotest takes its course.
MR. PEREZ (T.): But is it not a fact that the deposit spoken of in this project is to be asked of the protestant and not of the protestee?
MR. JOVEN: Yes, the protestee too if there any
MR. PEREZ (T.): The last sentence of Rule I says "Si expirado el plazo fijado, no se hace dicho deposito, el Comite podra declarar sobreseida la protesta o contraprotesta en cuestion."
MR. JOVEN: Yes, I am referring to that precisely.
MR. PEREZ (T.): Will the Gentleman cite an instance in which the protestee may pay a deposit?
MR. JOVEN: But this provision does not speak of protestee but of protestant.
MR. PEREZ (T.); Because I understand from this project, Mr. President, that the Committee on Credentials and Elections will fix the sum to be deposited and the time within which such deposit should be made, and that if no deposit is made, the Committee will declare the protest abandoned and, therefore, the protest should not prosper.
MR. JOVEN: Exactly, that is what I mean, that such power should not reside in the Committee but in the whole Convention.
MR. SANDOVAL: Mr. President.
EL PRESIDENTE: El Sr. Delegado por Palawan.
MR. SANDOVAL: Will the Gentleman yield to a question?
THE PRESIDENT: The Gentleman may answer if he so desires.
MR. JOVEN: With pleasure.
MR. SANDOVAL: Is it not a fact that before the Committee declares a protest or counterprotest dismissed, the Committee will report to the Convention, so that the Convention will decide whether the dismissal is proper?
MR. JOVEN: Under this rule as proposed, I think such eventuality will not occur because, as this rule is worded, it is the Committee that will declare whether or not the protest or counterprotest will it is understood, of course, that such decision of the Committee will be final. That is precisely the thing that should not happen.
MR. SANDOVAL: But that Committee will have to report its decision concerning the protest.
MR. JOVEN: That report is for the information but not for the decision of the Convention. Of course, the question whether or not the protest or counterprotest will be dismissed ....
MR. GRAFILO: Mr. President, may I ask a question?
THE PRESIDENT. The Gentleman may answer if he so desires.
MR. JOVEN: With pleasure, Mr. President.
MR. GRAFILO: I would like to bring to the attention of the author of the amendment that even then we may consider that the action of the Committee is final, notwithstanding that the Committee is supposed to report to the Convention about its work, and that the Convention may approve or disapprove what the Committee has done.
MR. JOVEN: In the first place, that is not the question. I would answer the Gentleman this way: that the Committee will, of course, make a report to the Convention, but under this rule, as it is framed, such report will be made for the information of the Convention, not for its approval because under this rule the Committee has the power to decide whether or not a protest or counterprotest be dismissed. That question will not be submitted to the Convention for decision under this rule, and my amendment precisely will give to the Convention as a Body the right to pass upon the report of the Committee on Credentials and Elections.
MR. GRAFILO: Mr. President, if the Gentleman is through I should like to register my turn against the amendment.
SR. OZAMIS: Sr. Presidente, ¿me permite el orador formularle algunas preguntas?

SR. OZAMIS: ¿No se obviaria esa dificultad que Su Señoria apunta, si se añadiera, por ejemplo, en la linea 15, despues de la palabra "cuestion," las palabras "y se rendira un informe de la decision tomada por el comite"?
MR. JOVEN: No, I do not believe so, Gentleman from Misamis. As I have stated before, it will not give this Body the power or authority to pass upon the report of the Committee; that is, this Convention will not then decide the question whether or not a protest or counterprotest will be dismissed.
MR. OZAMIS: Why not? Don't you think the Convention can reject any action taken by the Committee?
MR. JOVEN: But if we approve this resolution, then we shall have given that power to the Committee. We cannot then, even if we wanted to, disapprove the report of the Committee. We shall be faced with the necessity of rejecting a power which is already approved and granted to the Committee under this rule.
MR. OZAMIS: The Convention, even if it approves this rule now, can reject it any time, so that if the Committee renders its report to the Convention on its decision taken in any particular case, it is up to any Member of this Convention, if he thinks that the action of the Committee is unjustifiable, to call the attention of the Convention to the report given.
MR. JOVEN: Is that in the form of a question?
MR. OZAMIS: Just an explanation.
MR. JOVEN: Mr. President, I will answer any question, "but I will not tolerate any sort of lecture.
MR. BOCAR: Mr. President, will the gentleman yield?
THE PRESIDENT: The Gentleman may yield if he so desires.
MR. JOVEN: With pleasure.
MR. BOCAR: Is it not a fact that under the last three lines of Rule I, there is only one contingency, namely, that the protestant has failed to make the deposit?
MR. JOVEN: Well, I may concede that.
MR. BOCAR: For example, the Committee decides that the protestant has failed to make a deposit. Does the Gentleman mean to say that the matter will still be reported to the Convention?
MR. JOVEN: Precisely, that is what I mean to say so that the power to decide finally whether the protest or counterprotest be dismissed will reside in the Convention as a whole and not in the Committee on Credentials and Elections.
MR. BOCAR: If such report has been made to the Convention, is the Gentleman still in favor of giving to the protestant time within which to make the deposit?
MR. JOVEN: It depends upon the circumstances of a given case. I do not believe I can lay down any hard and fast rule until that question arises. Each case should be decided on its own particular merits.
MR. BOCAR: Does not the Gentleman think that under his amendment it will be unfair if the protestant has been given due time to make his deposit and he fails negligently to do so, and still appeals to the Convention for an extension of time?
MR. JOVEN: It depends on the particular circumstances of a given case. It may be unjust in one case and in another it may not be unjust.

Porque tal como esta el proyecto sometido por el Comite se desprende que el Comite tiene la facultad de sobreseer o no sobreseer y parece que eso no es la intencion del Comite.
EL PRESIDENTE: ¿Que dice el proponente de la enmienda?
MR. JOVEN: Mr. Chairman, I do not quite agree with the proposed amendment to the amendment, because then, the question of the dismisal or non-dismissal of a protest will be a thing that is decided. It will not be necessary for anybody, even if the rule were to be worded that way, to declare that the protest or coun-terprotest is dismissed because the mere fact that the protestant or counterprotestant fails to deposit the required amount within that period fixed by the Committee will have the effect of dismissing the protest or counterprotest which is, in my opinion, worse than the rule as it is framed.
MR. SANTOS: Mr. President.
THE PRESIDENT: The Delegate from Nueva Ecija.
MR. SANTOS: Mr. President, before voting on the resolution, I would propose another amendment, because this Rule I, while it gives power to the Committee on Credentials and Elections to fix the amount, of the bond, does not fix a maximum amount that can be a limit for the Committee in imposing as a condition for going on with the protest. I, therefore, propose an amendment, on lines Nos. 11 and 12.

SR. ROMUALDEZ: El Comite rechaza la enmienda, porque puede presentarse una necesidad de traer urnas de una parte distante. ¿Por que no se deja a la discrecion del Comite la cuantia? Por que aunque mi deseo es conformarme para obviar dificultades, no me atrevo, sin embargo, a hacerlo y prefiero dejarlo a la Convencion.
EL PRESIDENTE: ¿Insiste Su Señoria en su enmienda?
MR. SANTOS: I insist, Mr. President.
EL PRESIDENTE: Tiene la palabra el Delegado Santos.
MR. SANTOS: Mr. President, I insist on the ground that legislative bodies are the object of criticism for the occurrence of cases where duly elected members are deprived of their seats merely for their inability to afford the necessary amount of bond. This Constitutional Assembly, I believe, could be free from such criticism if we set a limit as to the maximum amount of bond that the Committee may impose. I do not question the integrity or the fairness of the Committee, but Mr. President, we want to lay down rules and regulations which I believe should not be subject to any criticism either fiom outside or inside this Chamber.
MR. ABORDO: Mr. President, will the Gentleman yield?
MR. SANTOS: I would like to continue and then answer the Gentleman from Palawan afterwards.
(Continuing.) The object, therefore, is to fix rules and regulations which will be unchangeable and cannot be subject to criticism. The amount of five hundred pesos fixed as a maximum limit for the bond, I sincerely bslieve, will be enough to pay the expenses, whatever probable expenses may be incurred even though the pro-testant may come from the Province of Davao or Sulu which is very far from Manila. The object, therefore, is just to follow the ordinary procedure in cases like this in which a maximum limit is fixed. As I have said, I do not question the integrity of the Members of the Committee; much less do I question the fairness which they will exercise over this matter. But I believe it is very necessary that there be a limit of the amount of the bond that could be required by that respectable Committee of this Assembly.
I am ready to answer the question of the Gentleman from Palawan.
MR. ABORDO: Suppose that the expenses to be incurred in the disposal of a certain protest pending before the Committee on Credentials and Elections exceed five hundred pesos, what rule would the gentleman apply?
MR. SANTOS I do not think there is room for such a question, because I know that the expenses of an election protest, especially, in the case of a delegate in which there are only two candidates voted, will not exceed the amount of five hundred pesos. Even the House of Representatives, as I said, fixed the amount of five hundred pesos. And I don't see any reason why we should dare fix an amount which will be greater than that fixed by the House of Representatives.
MR. ABORDO: Suppose in a certain protest case, witnessses will have to be brought from the provinces to appear before the Committee. Does not the gentleman think that expenses will have to be incurred in this matter?
MR. SANTOS: I know that expenses will be incurred. but I know that they will not exceed the amount of five hundred pesos.
MR. ABORDO: In a regular protest before the Court of First Instance, say, for governor, does not the gentleman think that expenses to be incurred will exceed five hundred pesos?
MR. SANTOS: Well, that is an entirely different case because a provincial governor is elected by the whole province whereas a delegate is elected in several cases by one-seventh of the province if you take the case of the province of Cebu or in the province of Nueva Ecija where there are two delegates for one representative district, one delegate is elected by one-half of the province and necessarily the expenses will be much less.
MR. ABORDO: In a certain province where there is only one representative district, suppose the election. of a delegate is protested, does not the gentleman think that the expenses to be incurred in court where the gubernatorial chair is protested are the same as the expenses to be incurred in a protest case for a delegate prosecuted before this Assembly?
MR. SANTOS: If the province has but one representative district, the supposition is that the province is small; necessarily the expenses will be also small and therefore not more than five hundred pesos.
MR. GRAFILO: Mr. President, I want to present an amendment to the amendment, to wit; to require of the protestant or counterprotestant a cash deposit which shall not exceed five hundred pesos and a bond which shall not exceed five thousand pesos.

Voy a razonar mi enmienda, Sr. Presidente.
EL PRESIDENTE: La Mesa quiere saber si el proponente original de la enmienda acepta la enmienda a la enmienda.
MR. SANTOS: I feel sorry not to be able to accept the amendment because I believe the amount of one hundred pesos will not be enough in most cases.
MR OSIAS: Mr. President, I want to be heard on the amendment to the amendment very briefly. In the House of Representatives, the amount, I have been informed, is two hundred pesos. It is unbecoming that a protest against a Delegate-elect or a Delegate to this Convention, an office which carries no salary, being purely honorific, according to the law, should have an amount fixed much greater than that fixed for the House of Representatives.
I presented the amendment to the amendment, Mr. President, merely to point out that the principle involved is wrong because the decision is based entirely upon monetary considerations. The man who protests or presents a protest does so primarily in defense of a principle and not because of any interest, monetary or material. As the rule has been amended now if the deposit is not made within the time fixed, the protest is ipso facto dismissed. That is why I say it is positively wrong in principle because it makes it continent absolutely and entirely upon the ability or inability of a man to present the cash deposit required therein. I care not in reality whether the amount shall be fixed at one hundred or five hundred pesos. However, there should be a. widespread opposition to prevent the presentation of protests of this nature, especially when the protest is made entirely for purposes other than defending a principle.
Mr. President, I trust that the resolution as amended will be approved, or if not approved, that the amendment presented will be approved.
MR. CUADERNO: Mr. President, will the Gentleman from La Union yield?
EL PRESIDENTE: El orador puede contestar, si le place.

MR. CUADERNO: Does the Gentleman from La Union think that this amount of one hundred pesos will be sufficient to cover the expense of bringing the ballot boxes of the whole district which I understand is one of the cases that we have now on hand?
MR. OSIAS: I will quote the same statement of the Chairman of the Committee on Credentials who said to me: "I do not know". And I do not pretend to know much more of this affair than the Chairman himself.
MR. CUADERNO: Then, I would like to know, Mr. President, why the gentleman from La Union would fix an amount when he himself does not know the extent of the expenses.
MR. OSIAS: Because, Mr. Chairman, I am combating the principle that only those who are endowed with material possessions in the world should have the right to be heard in this Government of the Philippine Islands.
MR. CUADERNO: Mr. Chairman, I would like to know from the Gentleman from La Union if it is not only true in theory, but that, as a matter of practical proposition, the fixing of an amount without knowing the expenses, would be ridiculous to say least?
MR. OSIAS: Mr. President, it may appear ridiculous to the gentleman from Bataan, but the cold reality is that the financial level of the Philippine Islands has been reduced.
MR. CUADERNO: Mr. President, I would like to request the Gentleman from La Union to confine his speech strictly to the business of the Convention.
MR. OSIAS: I trust, Mr. President, that I have not indulged in any aspersion, but merely alluded to the post he holds. There is no desire on my part to impute any motive that is wrong. I only wish to say to this Convention that I feel that it is not theoretical, but it is very practical that there are some here who, if required to file a cash deposit of five hundred pesos, would not be able to do so, and I am not ashamed that I am one of them.
EL PRESIDENTE: La Mesa desea llamar la atencion del orador que es completamente anti-reglamentario hacer aqui alusiones personales.
MR. SANTOS: Mr. President, I repeat that I am sorry I cannot accept the amendment to the amendment. although I agree in principle with the Gentleman from La Union. The simple reason, Mr. President, is the fact that the amount of five hundred pesos is fixed as maximum which implies that we trust the discretion of the members of the committee to fix the amount even from one peso to five hundred pesos. The amendment to the amendment, therefore, is covered by the amendment, and for that reason, I decline to accept the amendment offered by the Gentleman from La Union, although I agree with him in principle that there should be leniency in this matter.
SR. LORENZO (P.): Sr. Presidente, presento la mocion de que el Articulo I de esta resolucion sea total-mente eliminado.

MR. KINTANAR: Mr. President, when the Gentleman from La Union says that he is combating the principle of making material possession a premium for this office, I can frankly say that I am with him. But in the meantime, Mr. President, I will say that the eloquent speaker from La Union did not get this correctly. The amendment says that the deposit shall not exceed five hundred pesos. If I understand rightly, Mr. President, this does not mean that in every case of election protest, the sum of five hundred pesos shall be exacted. The Committee may exact one peso, ten pesos fifty pesos or one hundred pesos, for that matter. We have to trust and depend on the good judgment of the Committee which fortunately happens to be headed by one of the most distinguished men of the nation. For this reason, Mr. President, I think that the remarks of the gentleman from La Union are utterly unfounded. The amendment leaves to the discreation of the Committee to exact one peso, one hundred pesos or five hundred pesos, and I trust that this Committee, headed by no less a person than Justice Romualdez, will not abuse its discretion and will exact the proper and correct amount.

MR. SANTOS: Mr. president, I am sorry to state that I cannot accept the amendment to the amendment.
SR. KAPUNAN: Entonces, Sr. Presidente, voy a razonar la enmienda a la enmienda.

SR. KAPUNAN: Sr. Presidente, la cuestion que se debate ahora, al parecer, no tiene ninguna importancia; pero si la examinamos en el fondo, es una de las cuestiones mas importantes, porque afecta precisamente a los Miembros de esta Convencion.
Sr. Presidente, no estamos aqui para entretenernos en cuestiones que puedan gustar, mas o menos, al auditorio; hemos sido enviados aqui por nuestro electorado para estudiar, considerar y decidir cuestiones que afectan el interes de toda la nacion. La vida de esta Convencion puede ser demasiada corta, puade que cesemos dentro de dos semanas, y el tiempo es precioso para nosotros. Ademas, la cuestion de las protestas es una que debe decidirse siempre con criterio estricto. La razon que yo voy a alegar aqui es proflucto de mi triste experiencia sobre protestas, y particularmente sobre fianzas. En la pasada Legislatura he tenido el honor de presidir, siquiera interinamente, el Comite de Cuen-tas. Sr. Fresidente, la experiencia a que yo me refiero es demasiado triste. Hasta ahora algunos protestantes de la Novena Legislatura Filipina no han podido pagar lo que debian pagar por los gastos en las protestas, y la Legislatura ha tenido que sufrir las consecuencias abo-nando dichos gastos. Yo no quiero decir aqui quienes son esos protestantes; pero puedo decir que dos protestantes no han pagado lo que debian pagar, lo que les ha exigido el Comite de Elecciones. Debemos velar por los fondos publicos, nosotros los que hemos venido aqui para ser los guardianes de esos fondos, de modo que los mismos no se malgasten; debemos procurar que los fondos publicos no se inviertan para los intereses particulares de los protestantes. De tal manera que el unico medio es que debemos exigir de los protestantes que depositen una cantidad suficiente, a discrecion del Comite, para cubrir los gastos necesarios, segun la naturaleza de las protestas. La cantidad minima que el Senado actual exige es de quinientos pesos. Yo se de algunos protestantes de quienes se les ha exigido la cantidad de dos mil quinientos pesos; y esto tiene su razon en los gastos de flete de las urnas, lo que van a percibir los que van a examinar las balotas, los comisionados que suelen cobrar de cinco pesos a diez pesos diarios, y suponiendo que dure el examen de las balotas y que sean veinte las urnas correspondientes a diez municipios, ¿saben los Sres. Delegados a cuanto ascenderian los gastos correspondientes a estos comisionados? ¿Seran suficientes quinientos pesos?
SR. RAFOLS: Sr. Presidente, para una pregunta al orador.
EL PRESIDENTE: El orador puede contestar, si le place.
SR. KAPUNAN: Con mucho gusto.
SR. RAFOLS: En el caso de que el fundamento de la protesta es la residencia del protestado, ¿cree Su Señoria justo que al protestante se le exija una cantidad de quinientos pesos, cuando no hay necesidad de que se traigan las urnas?
SR. KAPUNAN: Si de mi dependiera, las protestas bajo ese fundamento deben sobreseerse. Yo no quisiera dirigirme a los que estan presentes; pero yo digo que el que sea mas inocente que tire la primera piedra.
SR. RAFOLS: ¿Quiere el Caballero por Leyte que yo le repita la pregunta? Parece que la contestacion no es responsiva. Mi pregunta es, si el fundamento de la protesta es la falta de residencia del protestado, ¿cree Su Señoria justo que al protestante se le exija quinientos pesos cuando la resolucion de una protesta de esa clase no depende de las urnas?
SR. KAPUNAN: La proposicion es general sin hacer referencia a los motivos o fundamentos de la protesta. La regla que se establece bajo el proyecto que se discute no se refiere a los motivos de la protesta sino solamente a las protestas, y naturalmente no vamos a ser casuistas en nuestras reglas. Si no adoptamos un criterio fijo, quinientos pesos en metalico es una cantidad modica que creo puede cubrir de primera intencion los primeros gastos; pero si se fija en cien pesos la cantidad eso seria hacer fracasar el deseo y la voluntad . . .
SR. RAFOLS: ¿No es verdad, Delegado por Leyte, que el principio o argumento invocado por Su Señoria al fijar la cantidad de quinientos pesos, es por los gastos que podria ocasionar la traida de las urnas? ¿Y no es verdad que es preferible que se deje a la discrecion del Comite porque en caso de una protesta en que solamente se ha de abrir una urna, se podria fijar una fianza nominal?
SR. KAPUNAN: ¿Quiere decir el Delegado por Cebu que la fianza que se ha de prestar no es en metalico sino personal?
SR. RAFOLS: Es que en el proyecto de resolucion no se habla de fianza sino de deposito y Su Señoria propone que se exija un deposito de quinientos pesos por lo menos de tal manera que aquellos protestantes que sean pobres y no tengan esa cantidad para impugnar la credencial del protestado no podran sustanciar su protesta, porque no estan en disposicion de depositar la cantidad de quinientos pesos.
SR. KAPUNAN: ¿Por que se le va a considerar pobre a un hombre que tiene el valor de protestar?
SR. RAFOLS: ¿Su Señoria cree que es una condicion sine qua non para ser protestante el ser rico?
SR. KAPUNAN: No es eso, sino lo que yo digo es que muchos politicos estan sostenidos por detras por varios grandes hombres.
SR. RAFOLS: Eso sera en el caso de Su Señoria.
SR. KAPUNAN: Esa es la practica.
SR. RAFOLS: Pero es muy sensible que muchos de esos candidatos sostenidos por hombres grandes, suelen ser derrotados, y pongo por caso el de Su Señoria.

INTING: Having the experience with regard to election protests in the House of Representatives, and for the benefit of the Members of this Assembly who have not had the honor of being Representatives, will the Gentleman please inform us as to the regular expenses incurred in an election protest before the House of Representatives?
SR. KAPUNAN: Eso depende de la naturaleza de los fundamentos. Suponiendo que la protesta abarque todo un distrito senatorial, con los quinientos pesos no hay ni para traer las urnas.

MR. INTING: No, what I want, gentleman from Leyte, is a concrete case as to how much is incurred in a case that the gentleman has known in the House of Representatives .
SR. KAPUNAN: Segun mi experiencia, en ciertas protestas se han gastado dos mil pesos, y esta es la razon por que algunos no han podido pagar, y la Camara ha tenido que pagar por ellos. Esa es la razon por que pido que se consigne un deposito que no baje de quinientos pesos.
MR. SANTOS: Mr. President, may I ask one question? Is it not true that those cases which the gentleman has mentioned of election protests in the House of Representatives, the expenses of which have not been paid, are cases in which no deposit in money has been made, as provided by the rules and regulations therein?
SR. KAPUNAN: Sr. Presidente, se ha hecho un deposito de mas de quinientos pesos en un caso, y dicha cantidad no fue suficiente. Se exigieron nuevos depositos que tampoco fueron suficientes y acabaron por no pagar, sobre todo los que no han ganado la protesta.

RESOLUCION
AUTORIZANDO EL NOMBRAMIENTO DE UN COMITE QUE SE ENCARGUE DE BUSCAR UN LOCAL APROPIADO PARA OFICINAS DE LOS COMITES DE LA CONVENCION CONSTITUCIONAL.Se Resuelve, Autorizar, como por la presente se autoriza, al Presidente de la Convencion a nombrar un Comite compuesto de tres Delegados para que se encargue de buscar y obtener en arrendamiento, dentro del mas breve plazo posible, un local apropiado para oficinas de los Comites de la Convencion Constitucional. cercano al edificio de la Legislatura.
SR. CONFESOR: Sr. Presidente, para una enmienda en el sentido de que se busque tambien un local para las oficinas de los Delegados que no sean miembros de la Legislatura.
EL PRESIDENTE: ¿Que dice el proponente de la resolucion?
SR. CUADERNO: No tendria inconveniente a dicha enmienda pero creo que el gobierno no tiene dinero suficiente para alquilar un local para la oficina de todos.
EL PRESIDENTE: Tenemos un presupuesto limitado.
MR. CONFESOR: Mr. President.
THE PRESIDENT: The Delegate from Iloilo.
MR. CONFESOR: Mr. President, the great majority of the Members of this Convention are not Members of the Senate or of the House of Representatives. They do not have their private homes in the city or in the suburbs. They are paid only five pesos a day for attendance in the session. Confidentially, they cannot afford to rent suites in hotels here in the city where they can maintain a decent office as Members of this Convention. It is therefore necessary that the Delegates be provided with offices. I claim. Mr. Chairman, that a Delegate of this Convention is not below the rank and position of responsibility of a Representative or a Senator, and I do not see why Members of this Convention should not be given a decent office wherein they can concentrate on their ideas and study the questions that are brought to them for consideration from time to time. Of course, we know that certain Members of this Convention have big offices by virtue of their positions in the Government or in semi-governmental institutions as the Philippine National Bank.
MR. CUADERNO: Mr. President.

MR. CUADERNO: Mr. President, I object to the anusion.
EL PRESIDENTE: La Mesa ruega al Caballero por Iloilo se abstenga de hacer alusiones personales, de lo contrario se le declarara fuera de orden y no podra continuar en el uso de la palabra.

EL PRESIDENTE: Se ordena el descarte de las palabras impropias pronunciadas por el Caballero por Iloilo.
SR. OSIAS: Sr. Presidente, pido que se lea la parte descartada.

SR. OSIAS: Para que estemos informados.
EL PRESIDENTE: Se ordena el descarte de las palabras cuyo descarte se ha pedido.
SR. OSIAS: Por eso yo ruego a la Mesa que se ordene la lectura de las palabras descartadas.
EL PRESIDENTE: Leanse esas palabras pronunciadas por el Delegado por Iloilo si esas palabras no han sido oidas por el Delegado por La Union.

SR. OSIAS: ¿Toda esa oracion sera descartada?
EL PRESIDENTE: Las palabras impropias pronun-ciadas por el Caballero por Iloilo. El Caballero por La Union podra distinguir la propiedad o impropiedad de las mismas y la Mesa ha considerado impropias muchas de las palabras prounciadas por el Caballero por Iloilo. La Mesa no va a repetir aqui, palabra por palabra, cual de entre ellas son impropias.
MR. OSIAS: I want to make of record my exception to the ruling of the Chair.
EL PRESIDENTE: Hagase constar.
MR. CONFESOR: I want to register my most energetic protest against the ruling of the Chair made in a very dogmatic and partial manner.
EL PRESIDENTE: La Mesa ordena al Caballero por Iloilo que se siente, porque esta fuera de orden y no puede hacer uso de la palabra.
MR. GRAFILO: Mr, President, I move that the discussion of this matter be postponed for tomorrow.
EL PRESIDENTE: Se ha pedido que se suspenda la discusion de este asunto para mañana. ¿Que dice el proponente de la mocion?

La Mesa ha ordenado al Caballero por Iloilo que tome su asiento.
SR. CONFESOR: Sr. Presidente, quisiera saber de la Mesa bajo que fundamento se declara fuera de orden al Caballero por Iloilo.
EL PRESIDENTE: Porque el Caballero por Iloilo se esta separando del asunto en discusion. Esta ocupandose de materias completamente extrañas a la cuestion. Por eso se le ha declarado fuera de orden.
SR. CONFESOR: Protesto contra la decision de la Mesa.
EL PRESIDENTE: ¿Esta la Asamblea dispuesta a votar la enmienda presentada por el Caballero por Iloilo?

RESOLUCION
AUTORIZANDO A CUALQUIER MIEMBRO DE LA CONVENCION PARA HACER USO DE LA PALABRA SOBRE CUALQUIERA MATERIA CONSTITUCIONAL, BAJO CIERTAS CONDICIONES.Se Resuelve, Autorizar, como por la presente se autoriza, a cualquier Miembro de la Convencion para hacer uso de la palabra en cualquier dia de sesion sobre cualquier tema referente a la Constitucion, siempre que no haya ningun asunto pendiente y previo aviso por escrito enviado al Presidente de la Convencion por lo menos con veinticuatro horas de anticipation.
SR. MORALES: Sr. Presidente, si no hay objecion, pido que se vote la resolucion.
