[ EXECUTIVE ORDER NO. 379, November 24, 1989 ]

REALIGNING THE FUNCTIONS OF SUPERVISION AND CONTROL OVER THE INTEGRATED NATIONAL POLICE PURSUANT TO SECTION 31, CHAPTER 10, BOOK III OF EXECUTIVE ORDER NO. 292



WHEREAS, the Constitution, in its Article XVI, Section 6, provides, that:
The State shall establish and maintain one police force, which shall be national in scope and civilian in character, to be administered and controlled by a national police commission.  The authority of local executives over the police units in their jurisdiction shall be provided by law;
WHEREAS, under Book IV, Title VIII, Subtitle II, Chapter I, Section 18 of the Administrative Code of 1987, the Integrated National Police shall be under the supervision and control of the Department of National Defense, and under Chapter 11, Section 63, the Integrated Police Force shall be under the Department of National Defense;

WHEREAS, under Section 67 of the same Book, Title, Subtitle and Chapter of the Administrative Code of 1987, the Integrated National Police shall be subject to the command and supervision of the President and shall function directly under the Secretary of National Defense;

WHEREAS, under Book III, Chapter 10, Section 31 of the Administrative Code of 1987, the President is given continuing authority to reorganize her office and for which purpose she is authorized to take certain actions;

NOW, THEREFORE, I, CORAZON C. AQUINO, President of the Philippines, by virtue of the powers vested in me by law, do hereby order:

SECTION 1. In the exercise of its powers to maintain peace, law, order and public safety, the Integrated National Police (INP) shall be subject to the command, supervision and control of the President and shall function as such under the Office of the President.

SEC. 2. The National Police Commission shall exercise administrative control and supervision over all units of the Integrated National Police (INP).

SEC. 3. This Executive Order shall take effect immediately.

Done in the City of Manila, this 24th day of November, in the year of Our Lord, nineteen hundred and eighty-nine.
