[ EXECUTIVE ORDER NO. 201, January 14, 1949 ]

AMENDING EXECUTIVE ORDER NO. 107, DATED DECEMBER 3, 1947, ENTITLED “PROHIBITING THE EXECUTION OF GOVERNMENT CONTRACTS WHEREIN THE GOVERNMENT IS REQUIRED TO MAKE ADVANCE PAYMENT FOR SERVICES NOT YET RENDERED AND/OR SUPPLIES AND MATERIALS NOT YET DELIVERED”



By virtue of the powers vested in me by law, I, ELPIDIO QUIRINO, President of the Philippines, do hereby amend Executive Order No. 107, dated December 3, 1947, to read as follows:
“As a matter of administrative measure and for the security of the Government I, ELPIDIO QUIRINO, President of the Philippines, by virtue of the powers vested in me by law, do hereby prescribe that, except with the prior approval of the President, no government contract for public services and/or for furnishing supplies and materials to the Republic of the Philippines or any of its branches, subdivisions, agencies or instrumentalities shall be entered into if by the terms thereof, the Government is required to make an advance payment for services not yet rendered and/or supplies and materials not yet delivered.

“No payment, partial or final, shall be made on any contract without a certificate on the voucher therefor to the effect that the services and/or supplies and materials for which payment is contemplated have been rendered or delivered, as the case may be, in accordance with the terms of the contract and have been duly inspected and accepted. Such certificate shall be signed by the Chief of the Office having full knowledge of the facts of the case.

“Notwithstanding the foregoing, the chief of any bureau, office, agency or instrumentality of the Government may, with the approval of the Department head concerned, or of the Chairman of the Control Committee, Government Enterprises Council, in the case of government-owned or controlled corporations, furnish supplies and materials to any party who has a contract with any bureau, office, agency or instrumentality, if such supplies and materials are needed in the performance of the service and the value thereof does not exceed in any one month ten per centum (10%) of the value of the services already rendered, due and unsettled, as computed by the bureau, office, agency or instrumentality concerned.”
DONE in the City of Manila, this 14th day of January, in the year of Our Lord, Nineteen Hundred and Forty-nine, and of the Independence of the Philippines, the third.
