[ EXECUTIVE ORDER NO. 18, April 07, 2017 ]

REPEALING EXECUTIVE ORDER NO. 235 (S. 2003), STREAMLINING THE RULES AND PROCEDURES OF DEFENSE CONTRACTS AND FOR OTHER PURPOSES



WHEREAS, Republic Act (RA) No. 9184 or the "Government Procurement Reform Act of 2003" declared it a policy of the State to promote the ideals of good governance, with a view to transparency, competitiveness, streamlining, accountability, and public monitoring in the procurement process of government contracts;

WHEREAS, in line with the Government's program of good governance, Executive order (EO) No. 235 (s. 2003) was issued which, among others, limited the authority of the Secretary of National Defense to delegate approvals of procurement contracts and established a single Bids and Awards Committee for the Armed Forces of the Philippines;

WHEREAS, it has been observe that the implementation of EO No. 235 resulted in bureaucratic impediments and uneccessary delays in the procurement of important defense projects;

WHEREAS, since the issuance of EO No. 235, the Department of National Defense, the Armed Forces of the Philippines, and its civilian bureaus and agencies have identified and operationalized other reform measures to promote transparency, impartially and accountability in procurement transactions.

NOW, THEREFORE I, RODRIGO ROA DUTERTE, President of the Philippines, by virtue of the powers vested in me by the Constitution and existing laws, do hereby order:

SECTION 1. Repeal. EO No. 235 (s. 2003) is hereby repealed. All other orders, rules, regulations and issuances, or parts thereof, which are inconsistent with this Order are likewise hereby repealed or amended accordingly.

SECTION 2. Duty of the Secretary of Defense. The Secretary of Defense is hereby mandated to identify and institutionalize measures that will effectively monitor the operations of the separate Bids and Awards Committees which may be created pursuant to RA No. 9184, to ensure and promote transparency, impartiality and accountability in procurement transactions.

SECTION 3. Process. All defense procurement contracts, including those presently being processed and/or reviewed, shall hereafter be reviewed and or processed in accordance with RA No. 9184 and EO No. (s. 2005), as amended by EO No. 645 (s. 2007).

SECTION 4. Effectivity. This Order shall take effect immediately upon publication in two (2) newspapers of general circulation.
