[ EXECUTIVE ORDER NO. 618, September 14, 1953 ]

AUTHORIZING THE SECRETARY OF AGRICULTURE AND NATURAL RESOURCES TO TRANSFER TO THE IRRIGATION SERVICE UNIT OF THE DEPARTMENT OF AGRICULTURE AND NATURAL RESOURCES, FOR REHABILITATION AND SALE, ALL IRRIGATION PUMP SYSTEMS COMPLETE WITH ACCESSORIES, AT PRESENT BEING MAINTAINED, ADMINISTERED AND/OR HELD BY THE IRRIGATION PUMP ADMINISTRATION



WHEREAS, the national program for increased food, production can best be carried out with adequate irrigation facilities;

WHEREAS, experience has shown that the utilization of irrigation pump systems has considerably increased the crop yield per hectare;

WHEREAS, it is in the interest of the effective implementation of the irrigation program that the pump units now being maintained, operated and/or held by the Irrigation Pump Administration be transferred to the Irrigation Service Unit of the Department of Agriculture and Natural Resources, there to be rehabilitated and ultimately sold to farmers associations;

NOW, THEREFORE, I, Elpidio Quirino, President of the Philippines, by virtue of the powers vested in me by law, do hereby authorize the Secretary of Agriculture and Natural Resources to transfer all irrigation pump systems complete with accessories presently being administered, maintained and/or held by the Irrigation Pump Administration to the Irrigation Service Unit of the Department of Agriculture and Natural Resources at appraised value to be determined by a committee which the Secretary of Agriculture and Natural Resources shall create for the purpose.

To facilitate the rehabilitation and sale of the irrigation pump systems, the Secretary of Agriculture and Natural Resources is hereby authorized to enter into agreement with the Philippine Council for United States Aid and the Mutual Security Agency Special Technical and Economic Mission relative to financing the rehabilitation of the irrigation pump systems and liquidation of current obligations of the Irrigation Pump Administration other than that owing to the National Treasury of the Philippines represented by the P2 million revolving fund allotted by the Central Bank to the National Government for the Department of Agriculture and Natural Resources for irrigation pump projects pursuant to Republic Act No. 266.

The Secretary of Agriculture and Natural Resources, through the Irrigation Service Unit, shall rehabilitate and/or reinstall these pump systems, and sell them to farmers associations at the price made up exclusively of the cost of acquisition plus the cost of rehabilitation and other pertinent charges to be determined by the same aforementioned committee: Provided, however, That in no case shall the price of the rehabilitated pump systems exceed the cost of irrigation pump systems of comparable size and equipment when new: and Provided, further, That purchasers of the rehabilitated irrigation pump systems shall acquire ownership of the same free from all liens and encumbrances, except those provided by law.

So much of the gross proceeds of sale of the pump systems as will be necessary shall first be applied to the settlement of whatever amount may be owing to the Counterpart Fund Special Account by virtue of such agreement or agreements that may be entered into by the Secretary of Agriculture and Natural Resources with the Philippine Council for United States Aid and the Mutual Security Agency Special Technical and Economic Mission pursuant hereto, and the balance of the proceeds left thereafter shall be turned over to the Treasury of the Philippines to the credit of the Irrigation Pump Administration and applied to the liquidation of the aforementioned P2 million revolving fund allotted by the Central Bank to the National Government for the Department of Agriculture and Natural Resources for irrigation pump projects pursuant to Republic Act No. 266.
