[ EXECUTIVE ORDER NO. 76, March 15, 2019 ]

AMENDING EXECUTIVE ORDER NO. 201 (S. 2016), ENTITLED "MODIFYING THE SALARY SCHEDULE FOR CIVILIAN GOVERNMENT PERSONNEL AND AUTHORIZING THE GRANT OF ADDITIONAL BENEFITS FOR BOTH CIVILIAN AND MILITARY AND UNIFORMED PERSONNEL"



WHEREAS, Section 11{d) of Executive Order (EO) No. 201 provides that the fourth tranche salary schedule for civilian government personnel shall be implemented by 01 January 2019, subject to appropriation by Congress;

WHEREAS, Section 15(a) of EO No. 201 provides, among others, that the funding requirements for the compensation adjustment in fiscal years (FYs) 2017, 2018 and 2019 will be included in the proposed annual National Expenditure Program submitted to Congress for its approval;

WHEREAS, Section 25(7), Article VI of the Constitution provides that if, by the end of any fiscal year, the Congress shall have failed to pass th § general appropriations bill for the ensuing fiscal year, the general appropriations law for the preceding fiscal year shall be deemed reenacted and shall remain in force and effect until the general appropriations bill is passed by Congress;

WHEREAS, considering that by the end of FY 2018, the FY 2019 General Appropriations Act (GAA) is still pending with Congress, Republic Act (RA) No. 10964 or the "FY 2018 GAA," has been deemed reenacted beginning 01 January 2019; and

WHEREAS, due to the reenactment of the FY 2018 GAA, there is a need to identify an appropriate funding source to cover the requirements for the implementation of the fourth tranche compensation adjustment for civilian government personnel scheduled in 2019 under EO No. 201;

NOW, THEREFORE, I, RODRIGO ROA DUTERTE, President of the Philippines, by virtue of the powers vested in me by the Constitution and existing laws, do hereby order:

Section 1. Amendment. Section 15(a) of EO No. 201 is hereby amended to read as follows:

"Section 15. Funding Source. The funding sources for the amounts necessary to implement this Executive Order shall be as follows:

a) For national government agencies funded in the GAA, the amount needed for the compensation adjustment in FY 2016 shall be charged against the appropriations provided in the FY 2016 GAA.

The funding requirements for the compensation adjustment in FYs 2017, 2018 and 2019 will be included in the proposed annual National Expenditure Program submitted to Congress for its approval. Pending the enactment of the FY 2019 GAA, the funding requirements for the compensation adjustment for FY 2019 shall be charged against any available appropriations under the FY 2018 GAA, as reenacted, to be determined by the DBM, subject to existing budgeting, accounting and auditing rules and regulations.

The DBM, following the compensation adjustment strategy embodied in Section 1 hereof, and consistent with its authority under Section 7 of RA No. 6758, as amended, shall then be authorized to implement or adjust the compensation corresponding to the appropriations provided in the GAA."

Section 2. Repeal. All issuances, orders, rules and regulations or parts thereof inconsistent with the provisions of this Order are hereby repealed or modified accordingly.

Section 3. Effectivity. This Order shall take effect immediately upon its publication in a newspaper of general circulation.
