[ ADMINISTRATIVE ORDER NO. 80, October 13, 1938 ]

REQUIRING AUXILIARY JUSTICE OF THE PEACE DANIEL CORRO OF BARUGO, LEYTE, TO RESIGN FROM OFFICE



This is an administrative case filed by Vicente Araza against Daniel Coro, Auxiliary Justice of the Peace of Barugo, Leyte. It is alleged that while acting as Justice of the Peace, the respondent, without any trial, acquitted the accused in a certain criminal case for theft of abacá filed by the herein complainant. During the investigation conducted by the Provincial Fiscal of Leyte the respondent admitted the charge but he defended himself on the ground that he believed the defendant had a good defense. The respondent further admitted that in dismissing the case, he did not issue any order to that effect but only noted his action on the criminal docket of the court. It was also established at the hearing that the complainant was not notified of the outcome of the case.

After carefully reviewing the evidence of record, I find that the respondent lacks knowledge of the elementary rules of court proceedings The mistakes committed by the respondent are undoubtedly due to the fact that he is not a member of the bar. To prevent further miscarriage of justice, it is imperative that the respondent be separated from the service.

In view of the foregoing, and concurring in the recommendation of the Secretary of Justice, the respondent, Daniel Corro, is hereby ordered to resign as Auxiliary Justice of the Peace of Barugo, Leyte, immediately upon the receipt of this order.
