[ PROCLAMATION NO. 538, January 20, 2004 ]

EXCLUDING FROM THE OPERATION OF PROCLAMATION NO. 120, S.1936, WHICH ESTABLISHED A MILITARY RESERVATION, CERTAIN PARCELS OF LAND LOCATED IN THE MUNICIPALITY OF GLAN, PROVINCE OF SARANGANI AND DECLARING THE SAME AS SOCIALIZED HOUSING SITE UNDER THE ADMINISTRATION OF THE NATIONAL HOUSING AUTHIRITY AND PROVIDING FOR ITS DISPOSITION TO ACTUAL BONIFIDE OCCUPANTS IN ACCORDANCE WITH THE PROVISIONS OF RA 7279, S. 1992 AND EO NO. 131, S 2002

WHEREAS, it is priority concern of the Government to provide housing to homeless Filipinos in line with the constitution mandate for the State to protect and advance the right of the people to a balanced and healthful ecology, decent living conditions and social justice;

WHEREAS, Executive Order No. 131, s. 2002, established mechanism implementing the provisions of Republic Act No. 7279, otherwise known as the Urban Development and Housing Act of 1992, to dispose of as socialized housing sites/lots government-owned lands that have not been used for the purposes for which they have been set aside for the "past ten (10) years" ( reckoned from 1992, when Republic Act No. 7279 took effect) and are suitable for socialized housing;

WHEREAS, pursuant to Section 5 of Executive Order No. 131, s. 2002, the NHA, under the supervision of HUDCC, shall take the lead in the disposition of the lands declared as socialized housing sites under UDHA.

NOW, THEREFORE, I, GLORIA MACAPAGAL-ARROYO, President of the Philippines, do hereby declare as excluded from the operation of Proclamation No. 120, s. 1936, certain parcels of land covering an area of 20,000 square meters, located in the Municipality of Glan, Province of Sarangani and declaring the same as socialized housing site under the administration of the National Housing Authority for disposing the actual bona fide occupants in accordance with the provisions of RA 7279, s. 1992 and EO No. 131, s. 2002, subject to private rights, if any there be, and to final survey, which portion of land are more particularly described as follows:


Beginning at the point marked "1" on Bureau of Lands BLBM No. 1 Glan Town site, thence North 100.00 m. to point 2, East 100.00 m. to point 3, South 100.00 m. to point 4, West 100.00 m. to point 1; point of beginning, containing an area of 10,000 square meters, bounded on the North and East, by Lot 415; and on the South and West, by Road


Beginning at appoint marked "1" on Bureau of Lands Plan SWO 14751, N. 1 deg. 16’ W., 225.06 m. more or less from BLBM No. 1 Glan Town site, thence North 100.00 m. to point 2, East 100.00 m. to point 3, South 100.00 m. to pint 4, West 100.00 m. to point 1; point of beginning, containing an area of 10,000 square meters, bounded on the North and West, by Lot 415; and on the South and East, by Road.

Except in Favor of the Government or any of its branches or agencies, all land disposed of under this proclamation shall not be subject to alienation and encumbrance foe a term of ten (10) years from the issuance of title in case of sale, or execution of contract in case of lease, nor shall become liable to the satisfaction of any debt contracted prior to the expiration of said period; but the improvements on the land may be mortgaged to qualified persons, associations or corporations.

The existing PNP Maritime Detachment located at northeastern part of Block No. 13 shall be retained for maritime purposes under the PNP.
