[ PROCLAMATION NO. 409, June 23, 2003 ]
DECLARING CERTAIN PARCELS OF LAND SITUATED IN BRGY. APAS, CEBU CITY AS SOCIALIZED HOUSING SITES UNDER REPUBLIC ACT NO. 7279, OTHERWISE KNOWN AS THE URBAN DEVELOPMENT AND HOUSING ACT OF 1992, AND FOR OTHER PURPOSES
WHEREAS, under Republic Act No, 7279, otherwise known as the Urban Development Housing Act of 1992 (UDHA), certain lands owned by the government or any of its subdivisions, instrumentalities or agencies, including government-owned and controlled corporations and their subsidiaries may be disposed of or utilized for socialized housing purposes;
WHEREAS, Executive Order No. 131, s. 2002, provided for the implementing mechanism of the above mandate under UDHA; and
WHEREAS, certain parcels of land or portions thereof situated in Brgy. Apas, Cebu City, come under the scope of UDHA relative to certain lands as abovementioned.
NOW, THEREFORE, I, GLORIA MACAPAGAL-ARROYO, President of the Republic of the Philippines, 6y virtue of the powers vested in me by law, do hereby declare as socialized housing sites under the provisions of UDHA certain parcels of land being held by the AFP Central Command situated in Brgy. Apas, Cebu City, that are occupied by bonafide families therein, to wit, Lot Nos. 950, 1035-B, 1076, 1102, 1104, 1105, 1106, 1107, 1110, 1113, 1122, 1124, 1125, 1176, 1177, 1178, 1179, and 1180, containing an aggregate area of 32.27 hectares, subject to private rights, final survey and the requirements of rational development and public/quasi-public use.
The abovementioned lands are hereby placed under the administration of Housing and Urban Development Coordinating Council/National Housing Authority (HUDCC/NHA) pursuant to the provisions of UDHA, Executive Order No. 131, and related issuances.
The Department of Budget and Management shall provide the funding requirements for the activities to be undertaken by HUDCC/NHA pursuant to the provisions hereof.
The Department of Environment and Natural Resources shall undertake the boundary, topographic and structural surveys and other activities necessary, in cooperation with HUDCC/NHA, the local government units concerned and other stakeholders, in the delineation of the area subject hereof.
IN WITNESS WHEREOF, I have hereunto set my hand and caused the seal of the Republic of the Philippines to be affixed.
