Upon recommendation of the Secretary of Environment and Natural Resources, and by virtue of the powers vested in me by Law, I GLORIA MACAPAGAL-ARROYO, President of the Republic of the Philippines, do hereby declare as civil reservation for socialized housing purposes under the administration of the City Government of Bais, a certain parcel of land of the public domain situated in the City of Bais, Province of Negros Oriental, containing an area of ONE HUNDRED FIFTY SIX THOUSAND FIVE HUNDRED EIGHTY SEVEN (156,587) square meters, more or less, subject to private rights, if there be any and to actual survey, which parcel is more particularly described as follows:


A PARCEL OF LAND (Lot No. 734-E-2, Portion of Lot 734, Cad-115), Bais Cadastre, Timberland), situated in the Barangay of Poblacion, City of Bais, Province of Negros Oriental, Island of Negros. Bounded on the SW., along line 1-2 by Lot 734-D portion of Lot 734 which is inside A & D; on the NW., SW., and SE., along line 2-3-4-5 by lot 63, Cad.-115, Bais Cadastre; on the Sw., along lines 5-6-7-8 by Lot 734-C portion of Lot 734 which is inside A & D; along lines 8-9-10 by Lot 37, Cad. – 115, Bais Cadastre; along line 10-11 by Lot 734-B portion of Lot 734 which is inside A & D; along Line 11-12 by Lot 33; along line 12-13 by Lot 32 both of cad. – 114, Bais Cadastre; along line 13-14 by Lot 734-A portion of Lot 734 which is inside A & D; on the NW., along lines 14-15-16 with Tavera Streer by Lot 734-E-1 (Timberland) Fishpond; on the NE., and SE., along Lines 16-17-18-19-20-21-22-23- by Boundary parcel –1, Cad. –115, Bais Cadastre; on the SE., along line 23-24 by Cad. –115, Bais Cadastre; on the SW., and SE., along lines 24-25-26-27-1 by Lot 725, Cad. – 115, Bais Cadastre, Beginning at a point Marked "1" on plan being N 84 deg. 28’E., 83.13.m. from BBM No. 1, Bais cadastre, Cad. –115, thence:

All points are marked on the ground by P.S. Cyl. Conc. Mons. Bearings True. Surveyed in accordance with law and existing regulations promulgated hereunder by Geodetic Engineer Emmanuel F. Malate."

Any mangrove/swampy areas found inside the area herein reserved is hereby segregated from the coverage of this proclamation and should not be disturbed nor alienated.

The area herein reserved as Civil Reservation for resettlement and agricultural site purposes shall not be used for any other purpose. However, beneficiaries may be awarded with special forest landuse agreements in accordance with the provisions of Presidential Decree No. 705 otherwise known as the Forestry Code of the Philippines and related rules and regulations.

A Local Inter-Agency Committee (LIAC) is hereby created with the Housing and Urban Development Coordinating Council (HUDCC), as Chair, the City Government of Bais of Co-Chair, the Department of Environment and Natural Resources (DENR), the Presidential Commission for the Urban Poor (PCUP), and a representative of the People’s Organization (PO) in the area as members. The LIAC shall formulate the implementing rules and regulations of this proclamation.

The cutting, gathering and utilization of all natural resources within the proclaimed site shall be subject to the existing DENR rules and regulations.
