[ MEMORANDUM CIRCULAR NO. 58, April 02, 2004 ]

DIRECTING ALL HEADS OF DEPARTMENTS, AGENCIES, BURUAUS, OFFICIES, INCLUDING GOVERNMENT-OWNED OR CONTROLLED CORPORATIONS, TO PROVIDE FULL ASSISTANCE AND COOPERATION TO THE PROVINCIAL GOVERNMENT OF BULACAN IN THE IMPLEMENTATION OF THE PROPOSED BYABAS DAM PROJECT IN THE MUNICIPALITY OF DONA REMEDIOS TRINIDAD, PROVINCE OF BULACAN

WHEREAS, the Province of Bulacan and its municipalities are experiencing extreme water shortage due to increased salt intrusion from Manila Bay; WHEREAS, the Provincial Government of Bulacan, hereinafter referred to as the "Provincial Government", through the Provincial Governor, has recommended the implementation through a Build-Operate-Transfer (BOT) arrangement or any other appropriate schemes the Bayabas Dam project in Dona Remedios Trinidad Bulacan; WHEREAS, the Provincial Government is authorized under Republic Act No. 6957, as amended, to enter into contract with any duly prequalified project proponent for the financing, construction, operation and maintenance of any financially viable infrastructure or development facility such the Bayabas Dam Project in the Municipality of Dona Remedios Trinidad, Province of Bulacan, subject to existing laws, rules and regulations. NOW, THEREFORE, GLORIA MACAPAGAL-ARROYO, President of the Philippines, by virtue of the powers vested in me by law, do hereby order: SECTION 1. Assistance.– All heads of departments, agencies bureaus, offices, including government-owned or controlled corporations ,are hereby enjoined to provide full assistance and cooperation, in accordance with law, to the Provincial Government of Bulacan in the implementation of the proposed Bayabas Dam Project in the Municipality of Dona Remedios Trinidad, Province of Bulacan, such as but not limited to the following:

1. Department of Environment and Natural Resources;
2. Department of Public Works and Highways;
3. National Economic Development Authority;
4. Metropolitan Waterworks and Sewerage System;
5. National Water Resources Board;
6. Local Water Utilities Administration;
7. National Irrigation Administration; and
8. Housing and Urban Development Coordinating Council

SECTION 2. Coordination and Monitoring. – The BOT Center of the Coordinating Council of the Philippine Assistance Program (BOT Center) shall be responsible for the coordination and monitoring of the Bayabas Dam Project with the BOT unit of the Provincial Government and the Project Development Officer of the Bayabas Dam Project. For this purpose, the Provincial Government shall periodically submit to the BOT Center on the status of the Bayabas Dam Project. The BOT Center is hereby mandated to guide the Provincial Government in the preparation and development of the Bayabas Dam Project. SECTION 3. Repealing Clause. – All executive issuances, rules and regulations or parts thereof which are inconsistent with this Memorandum Order are hereby repealed, amended, or modified accordingly. SECTION 4.
