[ MEMORANDUM CIRCULAR NO. 90, January 28, 2016 ]

CONSTITUTING AN INTER-AGENCY TASK FORCE TO CRAFT A HOUSING AND RESETTLEMENT FRAMEWORK FOR THE NLEX C-5 LINK PROJECT



WHEREAS, the North Luzon Expressway (NLEX) Concession Agreement consists of three (3) phases, one of which is the construction of a 7.85 kilometer road, known as the NLEX C-5 Link Project, that would link the NLEX and the C-5 Road;

WHEREAS, the Philippine Development Plan recognizes the crucial role of infrastructure in supporting the performance of the country’s economic sectors and ensuring equitable access to services, especially those affecting the people’s health, education, and housing; and

WHEREAS, the construction of the NLEX C-5 Link Project may cause the displacement of occupants within the area.

NOW THEREFORE, the following are hereby ordered:

Section 1. Creation. An Inter-Agency Taskforce (IATF) is hereby constituted to craft a housing and resettlement framework for the occupants who will be affected by the NLEX C-5 Link Project.

The IATF is hereby directed to submit its report to the Office of the President within ninety (90) days from the issuance of this Order.

Section 2. Composition. The IATF shall be composed of representatives from the following agencies:
Chairperson: Department of Public Works and Highways
  Department of Transportation and Communications
  Department of the Interior and Local Government (DILG)
  Housing and Land Use Regulatory Board Housing and Urban
Members: Development Coordinating Council
  Land Registration Authority
  National Housing Authority
  Presidential Commission on Urban Poor
  Social Housing Finance Corporation
The DILG shall constitute the Secretariat of the IATF.

Section 3. Assistance and Cooperation. All other departments, agencies, bureaus and offices of the government are hereby ordered to coordinate and extend assistance to the IATF to carry out its functions pursuant to this Circular.

Section 4. Repeal. All orders, issuances, or parts thereof, which are inconsistent with the provisions of this Circular, are hereby repealed or modified accordingly.

Section 5. Separability. If any provision of this Circular is declared invalid or unconstitutional, the other provisions not affected thereby shall remain valid and subsisting.

Section 6. Effectivity. This Circular shall take effect immediately.
