PENALTY FOR NON-COMPLIANCE WITH MEMORANDUM CIRCULAR NO. 88-017



Memorandum Circular No.88-017 (Re: Requirements for Payment of Annual Supervision and Regulatory Fee) requires operators to submit their fleet inventories or lists of registered units for the current year, attaching thereto photocopies of the Certificate of Registration and Official Receipts for payment of supervision fees on or before September 30 of every year. However, the Board has observed that operators failed to comply with the said Circular, thus supervision fees are not paid and collected in full and on time.

For stricter implementation, a penalty in the amount of Five Hundred Pesos (Php 500.00) per month shall be imposed against the operators who failed to comply with the said Circular. For this purpose, five (5) authorized units of an operator, regardless of the number of Case Numbers to which they are authorized, shall be considered as "fleet of utility vehicles."

This Memorandum Circular supersedes any and all issuances inconsistent herewith, and takes effect fifteen (15) days following the filing of three (3) copies hereof with the UP Law Center, pursuant to Presidential Memorandum Circular No.11, dated 09 October 1992.
