DISPOSITION OF FINES COLLECTED IN CONNECTION WITH ANTI-SMOKE BELCHING LAWS, RULES AND REGULATIONS IN METRO MANILA



WHEREAS, Metro Manila is a metropolitan region with such poor air quality that public health risks are already beyond tolerable limits;

WHEREAS, Paragraph f, Sec. 3 of R.A. 7924 provides that MMDA shall formulate and implement policies, rules and regulations, standards, programs and projects for the promotion and safeguarding of the health and sanitation of the region and for the enhancement of ecological balance and the preservation, control and abatement of environmental pollution;

WHEREAS, among the measures adopted by the MMDA is the monitoring and control of emission brought about by motor vehicles driven within the Metropolitan Manila area;

WHEREAS, the MMDA has been operating an exhaust emission testing center and has intensified its campaign against smoke-belching vehicles operating in Metropolitan Manila, fielding personnel to apprehend those motor vehicles that emit too much smoke and subject this, to an exhaust emission test;

WHEREAS, the Metro Manila Council recognizes the efforts of the enforcers of the anti-smoke belching campaign and grants them proper credit and incentives.

NOW, THEREFORE, pursuant to Sec. 6 of RA 7924, this Regulation hereby promulgated and adopted by the Metro Manila Council:

SECTION 1. The fines collected in connection with the enforcement of anti-smoke belching laws, rules and regulations shall accrue in favor of the following:

1. Twenty Five (25%) percent to Anti-Smoke belching enforcers of MMDA as incentive;

2. Five (5%) percent to the Local Government Units where the apprehension was made;

3. Ten (10%) percent for maintenance and operating expenses for the MMDA Anti-Pollution Action Center.

This Regulation shall take effect upon approval.
