WHEREAS, RA 7924 creating the Metropolitan Manila Development Authority, mandates the formulation and implementation of policies, rules and regulations, standards, programs and projects for the promotion and safeguarding of the health and sanitation of the region and for the enhancement of ecological balance, and the prevention, control and abatement of environmental condition;
WHEREAS, the Metro Manila Council, in its desire to regulate the indiscriminate dumping/littering/throwing of garbage, refuse, filth and other kinds of solid waste in public places, rivers, canals, drainage and other water outlets, enacted MMDA Regulation No. 96-009 Prohibiting Littering/Dumping/Throwing of Garbage, Rubbish or Any Kind of Waste in Open or Public Places, and Requiring All Owners, Lessees, Occupants of Residential, Commercial Establishments, Whether Private or Public to Clean and Maintain the Cleanliness of their Frontage and Immediate Surroundings and Providing Penalties for Violation Thereof;
WHEREAS, the Metro Manila Council members deem it proper that enforcers be given due credit for the efforts of implementing the aforesaid Regulation.
NOW, THEREFORE, pursuant to Section 6 of RA 7924, this Regulation is hereby adopted and promulgated by the Metro Manila Council:
SECTION 1. The fines collected in connection with the enforcement of MMDA Regulation No. 96-009 shall accrue in favor of the following:
1. One Hundred (100%) percent to the Local Government Units where the violation was committed if the apprehending officer is under the LGU concerned, provided that, the LGU may appropriate 10% of such fines collected as incentives to its enforcer who effects the apprehension.
2. Fifty (50%) percent to the MMDA and Fifty (50%) percent to the LGU where the violation was committed if the apprehending officer is an MMDA enforcer.
3. In relation to MMDA's total amount of apprehensions made by its deputized enforcers, ten (10%) percent shall be allocated to the MMDA Enforcement personnel to be deducted equally (5% each) from the shares of the MMDA and the LGU where the violation was committed.
4. Five (5%) percent of the MMDA share shall be allotted for maintenance and operating expenses for environmental sanitation enforcers' requirements.
This Regulation shall take effect upon approval.
