[ POEA MEMORANDUM CIRCULAR NO. 15, S. 1997, July 30, 1997 ]

AMENDATORY GUIDELINES ON THE ACCREDITATION OF JAPANESE PRINCIPALS HIRING OVERSEAS PERFORMING ARTISTS (OPAS)



Further to Memorandum Circular No. 10, dated May 5, 1997, the following additional guidelines are hereby issued for the information and guidance of all concerned:

GENERAL PROVISIONS

1.         Documents verified prior to June 9, 1997, the date of the effectivity of MC 10, may be considered for the accreditation of principals, provided that the requesting party is able to submit the additional requirements indicated in MC 10.

2.         The model employment contract need not be authenticated and verified.

3.         A verified manpower requirement/job order for a minimum of 50 OPAs spread over a period of one year shall be required.

4.         A certified true copy of the verified Memorandum of Agreement shall be submitted by the local industry association together with the list of association members which shall be updated as the need arises.

5.         The validity of accreditation is one (1) year unless sooner revoked by the contracting parties or by the POEA.

AMENDED DOCUMENTARY REQUIREMENTS FOR RENEWAL OF ACCREDITATION OF PRINCIPALS:

1.         Pre-qualification certificate of the foreign principal/promoter duly issued by the Office of the Labor Attache;

2.         A verified manpower requirement/job order for a minimum of 50 OPAs spread over one year;

3.         Verified affidavit of undertaking by the foreign promoter/principal using the new format per MC 10, Series of 1997 (if applicable);

4.         A certified true copy of the verified Memorandum of Agreement by the local industry association (if applicable);

5.         Bank certificate for the $20,000 escrow deposit of the principal; and

6.         Authenticated and verified Special Power of Attorney and Recruitment Agreement (if expired).

The provisions of MC 10 which are inconsistent herewith are modified accordingly.

This Circular shall take effect immediately.
