PRESCRIBING DRUG TEST FEE FOR GOVERNMENT -OWNED AND PRIVATE DRUG TESTING LABORATORIES ACCREDITED BY THE DEPARTMENT OF HEALTH



Pursuant to the powers vested in the Dangerous Drugs Board under Section 81 (b), Art. IX of RA 9165, otherwise known as the "Comprehensive Dangerous Drugs Act of 2002", in compliance with the instruction of the President and in conformity with the unanimous decision of the Board arrived at in its 68th Meeting on February 13, 2004, the DDB hereby prescribes the following rules and regulations;

Section 1. COVERAGE -- the fees herein prescribed to be charged per person shall apply to both government-owned and private drug testing laboratories accredited by the Department of Health.

Section 2. FEES per person shall be:

  1. For government-owned drug testing laboratories -- P200.00
  2. For PRIVATE owned drug testing laboratories -- not more than P250.00
  3. Both fees shall include the cost of screening and confirmatory tests when needed

Section 3. ADMINISTRATIVE SANCTION -- Subject to existing rules and regulations and after due notice, any drug testing laboratory found to be charging drug test fees higher than the herein prescribed amount shall suffer any of the following sanctions, to wit:

  1.     1st offense -- Reprimand
  2.     2nd offense -- Suspension of the License to Operate
  3.     3rd offense -- Revocation of the License to Operate

Section 4. EFFECTIVITY. This Regulation shall take effect fifteen (15) days after its publication in two (2) newspapers of general circulation and after registration with the Office of the National Administrative Register (ONAR), UP Law Center, Quezon City.
