WHEREAS, SRA Circular Letter No. 15, Series of 1991-1992, dated October 23, 1991 authorized the imposition and collection by mill companies of a P0.50 lien per picul of sugar produced by all planters from the start of the milling of the 1991-1992 crop and to continue indefinitely until otherwise revoked or modified;
WHEREAS, the Confederation of Sugar Producers Associations, Inc. (CONFED) has requested that the collection of the P0.50 lien per picul of the CONFED-Sugar Market and Development Fund (Confed-SMDF) collected from its planter-members be remitted directly to CONFED as designated Trustee of the PSMDF;
WHEREAS, in order to systematize and expedite the collections and remittance of the P0.50 lien per picul, the CONFED has executed and signed a Memorandum of Agreement with the Philippine National Bank and pursuant to such agreement PNB has authorized designated PNB Main Branches in sugar producing areas to accept payment of the P0.50 SMDF lien;
WHEREAS, the CONFED and the PNB have officially requested the Sugar Regulatory Administration to issue a Sugar Order to implement and enforce the Memorandum of Agreement;
NOW, THEREFORE, pursuant to the powers vested in the Sugar Regulatory Administration, it is hereby ordered that:
SECTION 1. The Philippine National Bank through its authorized main branches is hereby authorized to accept payment of the P0.50 per picul lien imposed on all sugar quedans of the 1991-1992 crop of the planter-members of planters associations/cooperatives affiliated with CONFED and to credit the same to the main current account in the name of the Confederation of Sugar Producers Associations, Inc. and to service the withdrawals for such main account in accordance with applicable banking rules and regulations.
SECTION 2. Receipt of deposit/payment of the P0.50 per picul Confed-SMDF lien shall be evidenced by Confed-SMDF’s Official Receipt and the Abstract of Official Sugar Warehouse Receipt (AOSWR) which shall be accomplished in triplicate. Copies of the official receipts and AOSWR shall be distributed as follows:
Original — Planter/Trader
Duplicate — PNB Buendia Branch
Triplicate — PNB Servicing Branch
SECTION 3. The List of Sugarmills and Servicing PNB Branches are those listed in “ANNEX A” (
see below). “ANNEX A” is an updated listing of all PNB Branches authorized to accept payments of the SRA liens and the SMDF lien.
SECTION 4. The applicable provisions of SRA Sugar Order No. 2 Series of 1991-1992 dated September 6, 1991 and those of various Circular Letters issued prescribing guidelines for the payment and remittance of the liens shall be applicable in the collection and remittance of the SMDF lien.
SECTION 5. Effective September 1, 1992, no mill company shall allow the withdrawal of planters’ share of the planter-members of planter associations/cooperatives affiliated with CONFED unless prior payment of the P0.50 Confed-SMDF lien has been paid to an authorized PNB Servicing Branch; otherwise the Confed-SMDF lien shall be the liability of the mill company concerned.
SECTION 6. This Order shall apply to all Confed planter-members/share quedans of the previous crop years with the Confed-SMDF lien and which have to date remained unwithdrawn; the planter share sugar of Crop Year 1992-1993, shall continue in effect in succeeding crop years until otherwise amended, modified, or revoked by subsequent sugar orders.
SECTION 7. In order to facilitate the identification of quedans belonging to CONFED members, beginning with crop year 1992-1993 and thereafter, mill companies are hereby instructed to mark, print, or stamp the phrase “CONFED MEMBER” at the appropriate space on the quedan and permit portion of all quedan-permits to be issued to individual planters or planters association/sugar cooperatives affiliated with CONFED. Sugar Traders are also advised to submit separate listings in the AOSWR for CONFED members quedans to facilitate processing payment of CONFED-SMDF lien to servicing PNB Branches.
SECTION 8. This Order shall take effect immediately. Provisions of sugar orders, circular letters, rules and regulations contrary to or inconsistent with this Order are hereby amended, modified or revoked accordingly.
