EFFECTIVE 15 OCTOBER 1992 ALL REQUESTS FOR ISSUANCE OF HOLD DEPARTURE ORDER TO THE BUREAU OF IMMIGRATION AND DEPORTATION SHALL BE SIGNED ONLY BY THE DIRECTOR, OR, IN HIS ABSENCE, THE ASSISTANT DIRECTOR, AND WHICH SHALL MEET THE CONDITIONS SET FORTH IN THE IMMIGRATION HOLD DEPARTURE GUIDELINES,



Effective 15 October 1992 all requests for issuance of HOLD DEPARTURE ORDER to the Bureau of Immigration and Deportation shall be signed only by the Director, or, in his absence, the Assistant Director, and which shall meet the conditions set forth in the Immigration Hold Departure Guidelines, stated as follows:

HOLD DEPARTURE GUIDELINES

An HDO shall be issued under several conditions among which pertinent to your cases, are:

a)      Pursuant to a court order in a criminal/habeas corpus case.

The requirement for an HDO under this category are an application by an interested party, furnishing the (BID) with a certified true copy of:

1.    The order of the court holding departure, or

2.    The criminal information/habeas corpus petition.

b)      Pursuant to a standing Warrant/Order of Arrest.

The requirements for an HDO under this category are an application by an interested party furnishing the Bureau with a certified true copy of the criminal information and the warrant or order of arrest, together with a certification of the Clerk of Court that the said warrant or order of arrest remains in force.
