MANDATORY DISPLAY OF FARE MATRIX AND PENALTIES FOR NON-COMPLIANCE THEREOF



It has come to the attention of this Board that up to this time there are still a number of operators who have not applied for the authority to charge the new fare adjustments and are already collecting the same from the riding public. There have also been reports that some operators are using and displaying fake Fare Matrices to the disadvantage and inconvenience of the riding public. Such acts are manifest violations of the terms and conditions embodied in the resolutions granting the new fare adjustments.

It is a well-established principle that in the grant of a Certificate of Public Convenience, the paramount consideration is always public convenience. It is the duty of this Board to serve and protect public interest. In so doing, this Board continually formulates and implements the appropriate and beneficial measures for the riding public, the drivers, and the operators.

In view thereof and with the implementation of the Fare Rate Adjustment for Public Utility Jitneys, and Airconditioned and Non-Airconditioned Public Utility Buses so as to protect the riding public from unreasonable and excessive fare charges and to identify the "Colorum operators" thereby protecting the legitimate operators and drivers from "colorum" operations, the following operators mentioned hereunder are hereby required to apply and secure the Fare Matrices for their units on or before the deadline provided to avoid apprehension:

Accordingly, any operator found violating the above provisions shall be subject to the following penalties:

b. Second Offense - Php1,000.00
c. Third Offense- Cancellation of Franchise
  
Fake Fare Matrix Displayed
  
a. First Offense- PhP5,000.00 and Thirty (30) day Suspension of Franchise
b. Second Offense- Cancellation of Franchise

The Law Enforcement Service of the Land Transportation Office is hereby directed to apprehend Public Utility Jitneys, Metro Manila Aircon and Non-Airconditioned Public Utility Buses, and Provincial Non-Airconditioned Public Utility Buses with no original fare matrices found and displayed in the vehicles. Photocopied matrix is allowed provided the original of which must be presented when demanded for comparison and validation. Enforcers are also directed to surrender all confiscated plates to the Legal Division of this Board for proper processing and disposition.

This Memorandum Circular supersedes any and all issuances inconsistent herewith, and takes effect fifteen (15) days following the filing of three (3) copies hereof with the UP Law Center, pursuant to Presidential Memorandum Circular No. 11, dated 09 October 1992.
