[ LTFRB MEMORANDUM CIRCULAR NO. 2009-017, September 23, 2009 ]

TURN OVER AND SURRENDER OF YELLOW PLATES (AMENDMENT ON MC 2008-022)

Considering the processing period involved from the time of application until actual release of Resolution/Orders and in view of the reasonableness of the request from affected transport operators, the Board hereby amends and modifies Memorandum Circular No. 2008-022 by allowing the surrender of yellow plates prior to release of Resolution/Order, instead of upon filing of the application/petition involving Dropping and Substitution of Units.

In this regard, no Order/Resolution involving Dropping and Substitution of Units shall be released except upon presentation and with submission of the required Receipt of Return Plate.

In cases of lost plates a corresponding certification and/or report duly issued by the Highway Patrol Group (HPG) of the Philippine National Police (PNP) and affidavit of loss shall be submitted.

All issuances inconsistent herewith are hereby superseded and amended accordingly.

This Memorandum Circular shall take effect (15) days following its publication in newspaper of general circulation and filing of three (3) copies hereof with the UP Law Center pursuant to Presidential Memorandum Circular No. 11 dated 9 October 1992.

Adopted: 23 Sept. 2009
