SWORN UNDERTAKING TO ASSIGN COMPANY REPRESENTATIVES OVERSEAS



Pursuant to Section 5, Guideline XII and Sections 1 and 3 of Guideline XI of the Insurance Guidelines on Rule XVI of the Omnibus Rules and Regulations implementing Republic Act 10022, it is hereby required that all accredited insurance providers shall sign a sworn undertaking indicating their agreement and concurrence to comply with the requirements stated in Sub-section C, Section 4, Guideline III of the Insurance Guidelines. The said undertaking shall be in accordance with the following form:

I, ______________ , in my capacity as (highest ranking officer of participating insurance company) of (name of insurance company) do understand and agree to comply with all the requirements stated in Sub-section C, Section 4, Guideline III of the Insurance Guidelines on Rule XVI of the Omnibus Rules and Regulations Implementing Republic Act 10022.

Based thereon, we undertake to provide a 24-hour call/assistance center and assign our own and exclusive company representative/s who will be stationed in host countries to facilitate claims servicing of overseas Filipino workers (OFWs) relative to their insurance coverage regardless of the number of policyholders that our company may have per host country in conformity with articles (1), (2), and (3) of Sub-section C, Guidelines III of RA 10022.

Non-compliance with this Circular shall be dealt with in accordance with the provisions of the Insurance Code, and the Insurance Guidelines. This is without prejudice to other penalties that may be imposed by other government agencies in accordance with the Omnibus Rules and Regulations of RA 10022.

The sworn undertakings shall be submitted not later than December 14, 2010 for those already accredited to date. Other insurers shall submit their pertinent undertakings as part of the requirements for accreditation.
