DTI ORDER ON ANTI-DUMPING CASE NO. 01-2009 ENTITLED “IN THE MATTER OF THE PRELIMINARY DETERMINATION OF THE ANTI-DUMPING PETITION AGAINST THE IMPORTATION OF MOSQUITO COILS FROM INDONESIA” – AHTN CODES 3808.1020, 3808.5012 & 3808.9120”



Pursuant to the 2nd  Indorsement dated 30 March 2010 of the Department of Finance (DOF) signed by Undersecretary Estela V. Sales, Legal & Revenue Operations Group on the request of this bureau for official directive relative to the letter dated 15 February 2010 of Secretary Peter B. Favila, Department of Trade and Industry (DTI) on the attached DTI Order on Anti-Dumping Case No. 01-2009 entitled “In the matter of the Preliminary Determination of the Anti-Dumping Petition Against the Importation of Mosquito Coils From Indonesia – AHTN Codes 3808.1020, 3808.5012 & 3808.9120” the dispositive portion of which is quoted hereunder:

"WHEREFORE, IN VIEW THEREOF, the Department of Trade and Industry acting  under paragraph f of Section 301 of the Tariff and Customs Code, as amended by RA   8752, found after preliminary determination, an affirmative finding of dumping on the  anti-dumping petition filed by Green Coil Industries, Inc. against mosquito coils from Indonesia.

As a consequence thereof, the corresponding provisional anti-dumping duty in the form of a cash bond will be imposed for a period of four (4) months from the effectivity of this   Order on importation of mosquito coils originating from Indonesia.

The petition will be forwarded to the Tariff Commission for formal investigation to determine whether or not there is a need to impose a definitive anti-dumping duty.

This Order shall take effect upon the issuance of the relevant Memorandum Order by the Bureau of Customs or 15 days after the publication of this Order in two (2) newspapers of general circulation, whichever comes earlier.

Let this Order be published in two (2) newspaper of general circulation and let the individual notices be sent to all interested parties including the country member concerned.

The said DTI Order has been published on March 22, 2010 issues of Manila Standard and Business Mirror.
