WHEREAS, pursuant to Sections 12 and 35 of R.A. No. 8050, known as the “Revised Optometry Law of 1995,” the Professional Regulatory Board of Optometry (herein after called the Board) issued and promulgated subject to approval of the Professional Regulation Commission (hereinafter called the Commission) Board Res. No. 01, Series of 2008;

WHEREAS, Sections 52 and 53, Rule XII of the said Board Resolution are provisions on the imposition of the requirements for the renewal of the professional identification card of a registered and licensed optometrist;

WHEREAS, the abovementioned provisions are contrary to Section 20 of R.A. No. 8981, known as the “PRC Modernization Act of 2000”, which reads, to wit: “Section 20. Repealing Clause. – Republic Act No. 546, Presidential Decree No. 223, as amended by Presidential Decree No. 657, Republic Act No. 5181, and Executive Order No. 266, Series of 1995 are hereby repealed. Section 23 (h) of Republic Act No. 7836, Section 4 (m & s). Section 23 of Republic Act No. 7920, and Section 29 of Republic Act No. 8050, insofar as it requires completion of the requirements of the Continuing Professional Education (CPE) as a condition for the renewal of the license [professional identification card] are hereby repealed. All other laws, orders, rules and regulations and all part/s thereof inconsistent with the provisions of this Act are hereby repealed or amended accordingly”; and (Enclosures in bracket supplied)

WHEREAS, the Board shall violate Secs. 32 (g) and 33 of R.A. No. 8050 if the aforequoted provisions are set forth in Board Resolution No. 01 aforestated;

NOW, THEREFORE, the Board resolves, as it is hereby resolved, to repeal and delete the provisions of Sections 52 and 53, Rule XII of Board RESOLUTION NO. 01, Series of 2008.

This Resolution shall take effect after thirty (30) days following its full and complete publication in the Official Gazette or any newspaper of general circulation in the Philippines.

Let copies of this Resolution be furnished the Application Division, Registration Division, and all other concerned Divisions of the Commission.
