RECALL OF MEMORANDUM CIRCULAR 2010-027, RE: APPLICATION FOR EXTENSION OF VALIDITY OF CERTIFICATE/S OF PULBIC CONVENIENCE (MODIFYING MC NOS. 2009-006 & 2010-004



On May 25, 2010, this Board issued Memorandum Circular 2010-027, Re: Applications for Extension of Validity of Certificate/s of Public Convenience (Modifying MC Nos. 2009-006 & 2010-004, wherein the said Memorandum, item No. 2 thereof , allows holders/grantees of CPCs, except those covering Metro Manila Bus Operations, to file Application for Extension of Validity of CPC which expired within one (1) year after the date of the expiration, subject to the terms and conditions contained therein.

However, after careful and thorough review of all previous and existing policies and guidelines pertaining to expired CPCs, this Board has resolved to recall the aforesaid Memorandum Circular, and hereby reinstates Memorandum Circular No. 94-011, Re: Non Acceptance of Application for Extension of Validity of Expired CPC dated August 31, 1994, pertinent portion of which reads as,:

“For the information and guidance of all concerned, the Board has decided that application for extension of validity of expired Certificate of Public Convenience shall no longer be accepted by the Board or by any of its regional offices.

All Public utility vehicle operators are, therefor, advised to file their applications for extension of validity of their CPCs on or before the expiration dates of such CPCs”

This Memorandum Circular supersedes and amends all issuances inconsistent herewith and shall take effect fifteen (15) days following its publication in a newspaper of general circulation and filing of three (3) copies hereof with the UP Law Center pursuant to Presidential Memorandum Circular No. 11 dated 9 October 1992.
