In order to address the difficulty of farmworkers in obtaining Social
Security System or other official documents, as primary proof of
employment for purposes of identification, screening and selection of
qualified agrarian reform beneficiaries, the Department of Agrarian
Reform shall recognize sworn statements of at least two (2)
disinterested persons as secondary or substitute proof that a person has
been a farmworker in the landholding subject of CARP coverage, provided
that:
- The disinterested person must first establish the circumstances
upon which his or her personal knowledge, concerning the identity and
the details of employment of the concerned farm worker, are based;
- The disinterested person must be of legal age, and has personal
knowledge of the identity of the farm worker, as well as the fact that
the said person is or was a farm worker in the landholding which is
being covered under CARP; and
- The disinterested person must know the period when the said
person worked in the farm, the nature of work undertaken, and the
position as well as compensation of the person concerned, if any.
The above facts must be included in the sworn statement for
purposes identification, screening and qualification as a
farmer-beneficiary, or in administrative inclusion proceedings. The
authorized persons under A.O. No. 5, Series of 2011 may administer the
oath for purposes of the abovementioned document. However, in view of
the approved Rationalization Plan of the Department, the Office of the
Center for Land Use, Policy, Planning and Implementation (CLUPPI) being
referred to under A.O. No. 5, Series of 2011 shall now pertain to the
Land Use Cases Division (LUCD) under the Office of the BALA.
This Memorandum Circular shall take effect immediately.
