AMENDING RULE 9 SECTION 2(C) OF THE BUREAU OF IMMIGRATION OMNIBUS RULES OF PROCEDURE OF 2015

WHEREAS, it is BI’s mandate to effectively and immediately deport fugitives from justice;
 
WHEREAS, Rule 9 Section 2(c) [Summary Deportation] of the Bureau of Immigration Omnibus Rules of Procedure of 2015 defines fugitive from justice as “a foreigner who has been tagged as such by the authorized personnel of a foreign embassy or by the International Police and whose passport is cancelled by his embassy/consulate.”
 
WHEREAS, the cancellation of the fugitive’s passport takes considerable amount of time;

WHEREAS, the delay in the cancellation of passports impedes the issuance of deportation orders and causes prolonged detention of fugitives from justice at the Bureau of Immigration Warden’s Facility worsening congestion problems and further burdening the Government;

NOW THEREFORE, pursuant to the rule-making power of the Commissioner under CA 613, Sec. 3, the following rules shall govern:

Section 2. (c) Fugitive from justice - A fugitive from justice refers to a foreigner who has been tagged as such by the authorized personnel of a foreign embassy or by the International Police or whose passport is cancelled by his embassy/consulate.

All inconsistent issuances are hereby repealed and/or modified accordingly. Effective upon publication.
